Terms of Service

By accessing or using Wine Memories ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.

1. Age Verification

BY USING THIS APP, YOU REPRESENT AND WARRANT THAT YOU ARE OF LEGAL DRINKING AGE IN YOUR JURISDICTION (21+ in the United States, 18+ in most other countries). You agree not to allow minors to access your account. False age representation may result in account termination.

2. Account Registration

You can use Wine Memories without an account (anonymous guest mode). To access all features, you must sign in with Apple or Google. You agree to:

  • Provide accurate information
  • Maintain the security of your account
  • Accept responsibility for all activity under your account
  • Notify us immediately of unauthorised access

We may suspend or terminate accounts that violate these Terms.

3. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

You may NOT:

  • Use the App for commercial purposes without written consent
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorised access to our systems
  • Use automated tools to scrape or collect data
  • Submit false, misleading, or offensive content
  • Interfere with other users or system operations

4. User Content

You retain ownership of content you create ("User Content"), including wine logs, tasting notes, photos, and comments.

By submitting User Content, you grant Wine Memories a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display such content for the purpose of operating and improving the App.

You represent that you have the right to grant this licence and that your content does not infringe any third-party rights. We may remove content that violates these Terms.

5. Intellectual Property

The App and its original content, features, and functionality are owned by Wine Memories and protected by international copyright, trademark, and other intellectual property laws. Wine region data, maps, and educational content are proprietary or licensed materials.

6. Subscriptions and Purchases

Some features require a paid subscription, managed through the Apple App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Refunds are handled by Apple or Google according to their policies.

7. Responsible Drinking

Wine Memories promotes responsible wine appreciation and education. This App does NOT encourage excessive alcohol consumption. You are solely responsible for your drinking decisions.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, secure, or error-free. Wine information is for educational purposes and may not be accurate or current.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINE MEMORIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL. Our total liability shall not exceed the amount you paid us in the past 12 months (or €100 if no payments were made).

10. Indemnification

You agree to defend, indemnify, and hold harmless Wine Memories from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or any alcohol-related incidents connected to your use.

11. Dispute Resolution

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Helsinki, Finland.

12. Termination

We may terminate or suspend your account at any time for breach of these Terms. You may delete your account at any time through Profile → Account → Delete Account, or by emailing oliver@winememories.fi.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the app. Continued use after changes constitutes acceptance.

14. Severability

If any provision is found unenforceable, it shall be limited to the minimum extent necessary and the remaining provisions remain in full effect.
